This Privacy and Personal Data Protection Policy explains what personal data we collect through the revistaelement.com website, its forms, our social media accounts, and the magazine’s other digital channels; why we use it, with whom we share it, how long we retain it, and how you can exercise your rights, in accordance with Law 81 of March 26, 2019, on the Protection of Personal Data in the Republic of Panama and its implementing regulations, Executive Decree 285 of May 28, 2021. It is intended for our readers, users, contributors, and advertisers.

1. Data Controller

2. What data we collect and why

We collect only the data necessary for each purpose:

• Contact form: name, email address, subject, and message. We use this information to respond to your inquiry or proposal (editorial, commercial, or advertising). Messages are stored in the website's system.
• Newsletter subscription: first name, last name, and email address. We use this information to send you our newsletter featuring content, events, and updates about the magazine. You can unsubscribe at any time using the link included in each email.
• Comments on articles: name, email address, IP address, and the content of the comment. We use this information to publish and moderate comments and to prevent spam. Your email address will not be published.
• In-store purchases: name, email address, phone number, billing and shipping addresses, and the products purchased. We use this information to process the order, coordinate delivery, issue receipts, and handle warranties or returns. We do not store payment card information on the site.
• Advertisers and business partners: contact information for representatives of brands, agencies, and collaborators. We use this information to manage advertising campaigns, editorial and commercial partnerships, and the corresponding agreements.
• Contests, sweepstakes, and promotional activities: the information you provide to participate, either through the website or our social media channels. We use this information to manage the activity and contact the winners, in accordance with the rules published for each event.
• Surveys and studies: the responses you voluntarily provide. We use them to better understand our audience and improve our content.
• Browsing and statistics: technical data such as IP address, device and browser type, pages visited, and time spent on the site, collected through cookies and analytics tools. We use this data in aggregate form to understand how the site is used and to improve it.

3. Legal Basis for Processing

We process your data based on your consent, which you provide when you submit a form, subscribe, leave a comment, or accept cookies; in the performance of a contract when you make a purchase; in compliance with legal obligations, such as tax and commercial obligations; and based on our legitimate interest in keeping the site secure. 4. Who We Share Your Data With

We do not sell or rent your personal data. To operate the site, we rely on service providers who process data on our behalf and are subject to their own confidentiality and security obligations:

• Mailchimp (Intuit Inc.): newsletter distribution and management.
• Google LLC: visitor statistics (Google Analytics and Google Tag Manager), spam protection for forms (reCAPTCHA), and embedded YouTube videos.
• Web hosting provider and content delivery network (hosting and Cloudflare): website storage and protection against attacks.
• Weglot: Translation of the website into other languages.
• Email service (SMTP): Sending emails generated by the site, such as form responses and order confirmations.
• Courier companies, using only the information necessary to deliver an order.
• Competent authorities, when required by law or court order.

5. International Transfers

Some of these providers store or process information on servers located outside of Panama, primarily in the United States. By using the site and providing us with your data, you consent to these transfers, which we carry out with providers that offer adequate safeguards in accordance with Law 81 of 2019.

6. Cookies

This site uses cookies and similar technologies:

• Technical or necessary cookies: These enable the website, shopping cart, comments, and security features to function.
• Preferences: They remember, for example, the language you selected or whether you've already seen a pop-up window.
• Analysis: Google Analytics allows us to track visits on an aggregate basis.

7. How long we retain your data

• Contact messages: the time required to respond to the request, up to a maximum of two (2) years.
• Newsletter: as long as you remain subscribed.
• Comments: as long as the comment remains posted.
• Orders: for the period required by Panamanian tax and commercial laws.
• Security logs and statistics: for limited periods, depending on each tool's settings.

Once these time limits have expired, the data is deleted or anonymized.

8. Your Rights

Under Law 81 of 2019, you may exercise your rights at any time to:

• Right of Access: Find out what personal data we process about you.
• Correction: correcting inaccurate or incomplete information.
• Cancellation: Request the deletion of your data.
• Objection: to object to a specific action, such as receiving communications.
• Data portability: receive your data in a structured, commonly used format.

We may ask you to provide information to verify your identity. We will respond within the timeframes established by law. If you believe your rights have not been addressed, you may file a complaint with the National Authority for Transparency and Access to Information (ANTAI).

9. Safety

We implement reasonable technical and organizational measures to protect your data from loss, misuse, unauthorized access, alteration, or destruction: encrypted connections (HTTPS), firewalls, protection against automated access, backups, and restricted access to information. No system is completely foolproof, but we work to maintain an appropriate level of protection.

10. Minors

This site is not intended for minors. If you are a minor, you must obtain permission from your parent or guardian before providing us with personal information. If we discover that personal information from a minor has been collected without such permission, we will delete it.

11. Changes to This Policy

We may update this policy to reflect changes to the site or to regulations. We will always post the current version on this page, along with the date it was updated.
